The clerk step

When a copy may need the $13 authentication.

The Secretary of State authenticates the signatures of California public officials. It apostilles county clerks, county recorders and the State Registrar directly. For a birth or death certificate signed by a health officer or county registrar, its guidance says county clerk certification “may be required.”

Santa Clara County’s Clerk-Recorder authenticates documents with “the signature of the Santa Clara County Medical Health Officer,” in person or by mail. Its fee schedule lists $13 for the first signature and $2.25 for each additional signature by the same officer at the same time. By mail, include a self-addressed stamped envelope.

Which official signed your copy decides whether the step applies. We read the signature block, get the authentication when it is needed, then file in Sacramento.

Rejection traps

What sends Santa Clara County files back.

We screen for each one in the $45 Document Check.

01A Medical Health Officer signature sent straight to Sacramento. A copy signed by the County Medical Health Officer may need the Clerk-Recorder’s $13 authentication first. We check the signature before anything is filed.
02A trip to the wrong counter. Public Health registers births and deaths but does not sell certified copies. Order from the Clerk-Recorder on West Tasman Drive.
03A confidential marriage certificate ordered by mail. It must be picked up in person by someone named on it, or by someone with a court order.
04A mail order without a notarized statement. An authorized copy ordered by mail or online needs a sworn statement signed in front of a notary.
05A photocopy instead of a certified copy. One of the most common catches in our Document Checks. A photocopy carries no official’s signature, so it cannot be apostilled. Fix: a new certified copy from the Clerk-Recorder.

Asked on Santa Clara County calls.

01

Can my Santa Clara County birth certificate go straight to the Secretary of State?

It depends on whose signature is on it. The Secretary of State apostilles county clerks’ and recorders’ signatures directly. If your copy is signed by the County Medical Health Officer, the Clerk-Recorder authenticates that signature first, $13 for the first signature. We read the signature block in the Document Check before any fee.
02

Where do I get the Medical Health Officer signature authenticated?

From the Clerk-Recorder’s Business Division, 110 West Tasman Drive, 1st Floor, San Jose, weekdays 8 to 4:30, or by mail with a self-addressed stamped envelope. The fee is $13 for the first signature and $2.25 for each additional signature by the same officer at the same time.
03

Where do I get a certified copy of a Santa Clara County divorce judgment?

From Santa Clara County Superior Court at the Family Justice Center Courthouse, 201 N. First Street, San Jose. By mail, send form FM-1183 to Superior Court – FJC Records Request, 191 North First Street, San Jose, CA 95113, with payment and a self-addressed stamped envelope. Certifying a dissolution judgment is $15, plus $0.50 per page, and $15 for research if you don’t have the case number.
04

Can I get a certified birth certificate from Santa Clara County Public Health?

No. Public Health’s Vital Records and Registration Office registers births and deaths, but it does not sell certified copies. Those come from the Clerk-Recorder, 110 W. Tasman Drive, San Jose, where in-person orders are usually processed the same day.
05

I no longer live in Santa Clara County. Can you handle it without me?

Yes. Have the certified copy shipped to our office at 416 Bryant Street, San Francisco, CA 94107, or mail us the one you hold. We check it, get any authentication it needs, file it in Sacramento and ship the apostille back tracked.
