San Francisco County · birth, death, marriage, divorce

Apostille for San Francisco records.
Two offices issue them.
A Public Health copy needs one more step.

A San Francisco birth certificate for someone under 3 comes from the Department of Public Health Office of Vital Records. For anyone older, it comes from the County Clerk at City Hall. A County Clerk copy goes straight to the Secretary of State. A DPH copy needs the County Clerk’s signature authentication first, because the Secretary of State does not have the local health registrar’s signature on file. We handle that step before filing.

The clerk step

Why a DPH copy needs one more signature.

The Secretary of State authenticates the signatures of California public officials. For birth and death certificates, that means county clerks, county recorders and the State Registrar. When a certificate is signed by a health officer or local registrar, its guidance says county clerk certification “may be required,” or a certified copy from the county recorder or the state instead.

San Francisco answers that directly: “The signature of the local health registrar is not available in the California Secretary of State’s records. The County Clerk must authenticate the birth or death certificate before the California Secretary of State office can provide you with the apostille service.” The 2023 law that put county health officers’ oaths on file with the state (AB 2324) does not change this for San Francisco copies.

The County Clerk authenticates in person, or by mail with the certified copy, payment, a cover letter requesting signature authentication and a self-addressed stamped envelope. Once it comes back, it goes to the Secretary of State for the apostille.

Rejection traps

What sends San Francisco files back.

We screen for each one in the $45 Document Check.

01A DPH birth certificate sent straight to Sacramento. Copies for children under 3 come from Public Health, not the County Clerk. The Secretary of State does not have the local health registrar’s signature on file, so it needs the County Clerk’s signature authentication first.
02The old County Clerk website. The legacy sfgov.org County Clerk pages are still online, including a 2018 calendar and notices that no longer apply. Current information is on sf.gov.
03A 2025 fee amount. California added $2 to certified birth, death, marriage and dissolution of marriage certificates on January 1, 2026. Forms printed earlier come up short. Court copies of a divorce judgment carry a separate court fee.
04A photocopy instead of a certified copy. A client made a copy of their certificate and sent that. A photocopy carries no official’s signature, so it cannot be apostilled. Fix: a new certified copy from the issuing office.

Asked on San Francisco calls.

01

Can my San Francisco birth certificate go straight to the Secretary of State?

If the County Clerk issued it, yes. If the Department of Public Health issued it, it needs the County Clerk’s signature authentication first. The signature block shows which office issued it, and we read it in the Document Check before any fee.
02

Where do I get a certified copy of a San Francisco divorce judgment?

From San Francisco Superior Court Civil Records, 400 McAllister Street, Room 103, which holds family law case files. A certified decree is $15, plus $0.50 per page, and a $6 retrieval fee if the file is stored off-site, which is common for cases two or more years old. In person, short requests for on-site files are ready while you wait. Mail requests may take 30 to 45 days.
03

Which office has a death certificate from last year?

The Department of Public Health Office of Vital Records issues deaths from the last 3 years, at $26 per copy as posted. Older deaths, back to 1906, come from the County Clerk at City Hall.
04

I no longer live in San Francisco. Can you handle it without me?

Yes. Have the certified copy shipped to our office at 416 Bryant Street, San Francisco, CA 94107, or mail us the one you hold. We check it, complete any City Hall step it needs, file it in Sacramento and ship the apostille back tracked.
